Many traffic accidents happen every year. A bicycle accident, scooter accident or a car accident. But what if you are hit by a car (Dutch: aangereden door auto)? What should you pay attention to and what personal injury amounts are eligible for compensation after a traffic accident?
What to do after a traffic accident
You are driving to work or the tennis club when you are suddenly hit from behind at the traffic lights. Or you fall while cycling because you are hit by a car. There is often injury resulting in damage. But how do you recover personal injury and what can you do yourself to successfully claim personal injury compensation?
Make sure a claim form is completed!
Perhaps the most important thing to be able to claim personal injury after a collision is to complete a claim form. Because you can provide important information on an accident form. For example, the circumstances of an accident.
If you are the victim of a car accident, scooter accident or have been hit as a pedestrian resulting in whiplash complaints (Dutch: whiplash klachten) you must prove the other party’s fault. You can do this by completing a damage collision form.
In Europe there is a claim form that is the same for all member states of the European Union, except for the language. On this accident form you can enter information that is important for your burden of proof. This makes it possible to describe the circumstances of an accident.
The circumstances of a collision are of course very important. After all, only if the other party has made a traffic error and this has caused the collision, can you hold the other party or its damage insurance liable. Therefore, always state the circumstances of a collision on the claim form and sign it! You can then be sure that you have met the burden of proof.
Do you have the damage collision form signed by the other party? Then the content is established between you and the other party. Your personal injury lawyer can then use the accident claim form to prove the other party’s fault.
Which damage items are eligible for compensation?
Have you and your personal injury lawyer been able to successfully prove the other party’s fault? Then you are entitled to compensation. But what amounts of personal injury are reimbursed after a traffic accident?
A traffic accident can have major consequences for you, both personally and financially. Because what if, for example, you can no longer work due to a collision? Or need help with the household?
First, the costs you have had to incur as a result of a traffic accident are eligible for reimbursement. Consider the costs of bicycle repairs or repairs to your car. But medical costs are also eligible for reimbursement, for example the physiotherapist’s bills.
In addition to costs and income damage, there is also a right to compensation for damages. You are always entitled to this if you have been injured in an accident or have suffered complaints such as whiplash. The only condition is, of course, that someone is liable for your personal injury.
Compensation for damages is compensation for pain complaints as a result of a traffic accident, but also for driving anxiety, sadness and psychological complaints. In other words, it is compensation for the suffering caused to you by the traffic accident.
