LGBTQIA+ travellers warned to stay away from Nigeria where same-sex sexual activity is illegal and can attract up to 14 years in prison

The British government said LGBTQIA+ travellers or even those who are just perceived to be members of the LGBTQIA+ community could face heightened security and legal risks in the country. It also noted that some states in Nigeria operate under Sharia law, under which same-sex sexual activity can attract the death penalty.

LGBTQIA+ travellers are warned to stay away from Nigeria due to the risk of arrest, violence, attacks, blackmail and intimidation since there, same-sex sexual activity is illegal and can attract up to 14 years in prison.

The warning was contained in the latest travel advice issued by the UK Foreign, Commonwealth and Development Office (FCDO) on Nigeria.

In the advisory, the British government said LGBTQIA+ travellers or even those who are just perceived to be members of the LGBTQIA+ community could face heightened security and legal risks in the country. It also noted that some states in Nigeria operate under Sharia law, under which same-sex sexual activity can attract the death penalty.

“Same-sex sexual activity is illegal in Nigeria with penalties of up to 14 years in prison,” the FCDO stated, adding: “Some northern states observe Sharia Law which can prescribe the death penalty for same-sex sexual activity.” 

There are provisions in Nigeria’s Same Sex Marriage Prohibition Act that provides for lengthy prison sentences for people involved in same-sex marriages. This law extends to those who help arrange or conduct such events, as well as those who attend such events.

The law also criminalizes activities involving LGBTQIA+ groups and organizations.

For the UK government, LGBTQIA+ travellers may also be exposed to social hostility and the possibility of physical attacks and intimidation. “There is an increased risk of violence, attacks and threats, such as blackmail and intimidation against anyone being thought to be part of the LGBT+ community or supporting their rights,” the advisory added.

The advisory also warned of:

  • Disruptions in communications particularly during periods of unrest or when authorities impose restrictions;
  • Possible imposition, amending or lifting of curfews and restrictions on vehicle movement at short notice;
  • Political rallies, protests and violent demonstrations, which could occur with little warning; and
  • Deaths and serious illnesses linked to alcoholic drinks containing methanol in Nigeria.
