Ohio Senate approves bill banning transgender student from accessing school restrooms

The Ohio Senate approved a bill that will require students to only use school facilities that are aligned with the sex assigned to them at birth. This was developed to particularly target transgender students.

The Ohio Senate approved a bill that will require students to only use school facilities that are aligned with the sex assigned to them at birth. This was developed to particularly target transgender students who – if this is passed into law – will be banned from using school restrooms aligned with their gender identity.

Ignorant of intersex people’s existence, Senate Bill (SB) 104 defines “biological sex” as the “biological indication of male and female” regardless of the student’s “psychological, chosen, or subjective experience of gender.”

SB 104 will:

  • require public primary schools, secondary schools, and institutions of higher education to designate all multi-occupancy student restrooms, locker rooms, changing rooms, or shower rooms “for the exclusive use by students of the male ‘biological sex’ (sic) only or by students of the female ‘biological sex’ (sic) only.”
  • prohibit schools from knowingly permitting members of one “biological sex” (sic) to enter facilities designated for the exclusive use of the other “biological sex” (sic).
  • Prohibit schools from labeling any multi-occupancy facilities as “nongendered, misgendered, or open to all genders.”

Highlighting the number of anti-LGBTQIA politicians in Ohio, the bill passed the state senate by a 24-7 vote. It was sent to the office of conservative Ohio governor Mike DeWine for approval.
