In Taiwan, same-sex marriage between its citizens and their foreign partners, even if their partner’s country does not allow same-sex marriage, are now recognized. However, this will still not cover same-sex marriages involving people who belong to mainland China because of “procedural issues”.
The Interior Ministry notified the local governments about this change that came after court rulings recognized the marriages of same-sex transnational couples, calling the rejection of such marriages unconstitutional.
Taiwan was the first in Asia to legalize same-sex marriages in 2019. Initially, the law only allowed a Taiwanese to marry their same-sex partners who were also citizens of Taiwan, while also allowing marriage between couples from countries where same-sex marriage is legal.
